从功能翻译理论的角度看合同翻译

论文摘要

自从上世纪中叶功能理论诞生并被引入翻译理论研究以来,翻译理论在有了长足的发展。无论是以奈达和纽马克为代表的功能对等理论,还是以赖斯,弗米尔为代表的功能学派提出的目的论,连贯性法则,“功能加忠诚”原则,至今都在翻译讨论中占据相当重要的地位,并产生了深远的影响。国内的学者也对此作过大量深入的研究,但这些研究主要集中在文学翻译领域,如诗歌翻译,小说翻译等等,而及法律英语翻译,尤其是合同翻译的研究却非常少。为此,本文力图将功能学派理论和合同翻译实践相结合,一方面从功能学派理论出发,为合同翻译制定原则,另一方面和笔者的翻译实践相结合,从下向上地提出一些合同翻译的策略,力求从微观角度为体现这些原则提供方法和路径。本文的第一章综合介绍了合同翻译,对合同翻译做了定义和分类,还对国内对合同翻译现有的研究状况做了综述。第二章首先以奈达的功能对等理论将开去,重点介绍了目前功能学派的主要理论,然后将功能学派理论和合同翻译相结合,分析并提出了合同翻译的四大原则,第三章从实践的角度出发,力求从翻译实践角度实践合同翻译的四大原则,为此,笔者首先从词,句,和语义的角度分析了法律合同的语言特征,然后有针对性地提出了一些翻译的应对策略的技巧,最后,笔者对全文进行了总结,并提出了不足之处及进一步研究的建议。中国的对外经济和商务交往越来越频繁,对商务合同中英文翻译的需求也越来越大,而合同翻译的质量对商务交易能否顺利进行有着至关重要的影响。笔者希望本文所作的研究能够为今后的合同翻译研究提供一定的借鉴。
