从比较法律文化的视角论法律术语翻译

论文摘要

本研究从比较法律文化的角度研究法律术语翻译。目前,法律翻译作为法律机制内的交流这种概念已被广泛接受。为保证法律专家们之间的法律交流成功,在翻译的过程中,译者不仅需要具有源语言及目的语的纯熟的语言技巧,且需要对源法律文化及目的法律文化有足够的知识。作为法律文本及法律文化的核心及基本元素,法律术语值得法律翻译者的特别关注。本文分析了法律文化差异如何影响译者的解码、编码及推理过程。源语法律文化及目的语法律文化之间的对应关系可以分为三个层次:邻近对应,部分对应以及零对应。作者也提出创造新词,解释性翻译以及其他特定可行的翻译策略,以跨越在法律术语翻译过程中所遇到的源语法律文化跟译入语法律文化之间的障碍。此外,本文也为法律翻译工作者提出了一些实际可行的建议。
