《国际商事合同通则2004》汉译本评析

论文摘要

《国际商事合同通则2004》(简称2004《通则》)是当今世界上一部极具现代性、广泛代表性与权威性的商事合同统一法。《通则》是国际统一司法协会主持制定的,于1994年出版了1994年版《通则》,经过10年的努力,在1994年版《通则》的基础上,新的版本(2004《通则》)于2004年4月以英文和法文的版本出版。《通则》已被纳入世界大多数国家的法学院和大学的课程和教学材料之中,已成为许多国家立法机关样板,我国1999年《合同法》就广泛受到《通则》的启发,其在合同谈判指导方面发挥着越来越多的作用,其重要性不言而喻。本文作者正是在这种情况下,认真阅读了《通则》的英文本,并与该《通则》的汉译本进行了仔细地对比研究,根据法律法规的特点,结合翻译理论与实践进行分析评述,从而进一步透析法律英语的词法、句法和文体特点及翻译策略和应该遵循的翻译原则,希望能为我国的法律文献翻译尽一份力。论文分为五部分：第一部分介绍了法律英语的定义及特点；第二部分介绍了翻译的概念、翻译的标准和法律英语汉译的翻译标准；第三部分简要介绍《国际商事合同通则2004》及本文拟讨论的汉译本；第四部分为主要部分,分别从词法、句法、文体等方面对上述汉译本加以评论,指出其长处,讨论其不足之处并提出适当的修改建议；第五部分简短总结
