汉英思维方式比较与法律文献的英译

论文摘要

随着我国经济的快速发展和对外交往的增多,人们越来越重视法律文献的翻译。作为一种跨文化交际行为,法律文献翻译必然会受到源语和目的语文化特别是思维方式的影响。本文尝试对中西方的思维方式进行探索和比较,试图对中西方思维方式的规律和各自的特点进行总结,并就思维方式对汉语法律文献翻译的影响进行了探讨。 第一章首先讨论了思维、语言和翻译之间的关系,指出:思维是人脑的一种认知功能,人类通过思维认知世界;人脑用语言思维,语言是思维的基本工具和物质外壳;翻译作为不同语言之间转换的一种过程,不仅是一种语言行为,更是一种思维行为。不同民族的思维方式虽相似之处颇多,但又各具特点。因此,本章的后半部分着重从四个方面对汉、英两种语言的逻辑思维以及他们对各自语言的影响进行了分析和对比,即:具象思维和抽象思维;综合思维和分析思维;主体思维和客体思维以及顺向思维和逆向思维。 第二章首先对当代中西方一些著名的翻译理论家及其理论进行了简要介绍,指出翻译作为一种跨文化交际的语言实践活动,是操不同语言者进行交流沟通和加强理解的桥梁。一方面,翻译理论离不开翻译实践;另一方面,翻译实践也离不开翻译理论的指导。为了使译文忠实、流畅、易懂,译者需要考虑文化、思维方式和翻译技巧等诸多因素。“目的论”突出翻译的目的,以行为理论和跨文化交际活动为理论框架,强调在翻译时应充分考虑源语和目标语的思维方式和文化背景等。从这个观点来
