文化差异与法律术语的翻译

论文摘要

法律翻译是文化交融的一座桥梁，法律术语的翻译又是法律翻译的一大障碍，直接影响着法律文本的翻译质量。然而，正确的法律术语翻译并非易事，它涉及到许多方面的因素，其中最重要的是源语和译入语中的文化因素。于是，本文从中英法律文化差异的视角去研究法律术语的翻译。全文共分为五章。第一章引言，分析了中英法律文化差异视角下法律术语翻译研究的重要性，从而揭示本文的课题研究目的。第二章简单介绍了文化的定义，及文化与语言、翻译的关系，从而导出法律文化与法律翻译的关系。第三章认真剖析了法律术语的背景知识，包括定义、特点及其分类,从法律体制、历史、思维方式、价值观念、社会习俗和宗教六个方面指出了中西方的法律文化差异给法律术语翻译带来的影响。第四章探讨了目前法律术语翻译中因文化差异导致的普遍问题，依照Sarcevic对法律术语对等程度的三个划分：接近对等、部分对等和完全不对等，阐述了法律术语翻译过程中应当遵循的四个基本实践原则。根据当前的研究成果，作者指出在法律术语翻译过程中应如何克服文化差异，并提出了三种在不同条件下相应的翻译方法：即对等或接近对等时用直译法，部分对等或不对等时用意译法，完全不对等时用释义、创造新词法。并用实例证明这些方法的可行性。第五章总结了该研究的主要发现以及需要进一步努力去研究并克服的问题，以期唤起译者在翻译法律术语过程中对法律文化差异的注意，共同寻求更多搭建这些差异的桥梁和通道，进一步提高法律术语翻译的质量。
