从法律文化差异看法律文本翻译的质量 ——以语料库为基础的研究

论文摘要

本文从法律文化差异的角度,探索对法律文本翻译造成影响的中西法律文化差异,以及造成这些影响的原因。本文采用霍斯的翻译质量评估模型,对原文与译文从以下方面进行对比:语场(包括了主题与社会行动),语旨(参与者间的关系,包括了作者的家乡籍贯与看法,社会角色间的关系与社会态度),语式(媒介与参与程度),以及体裁(包括了文本类型与格式)。对法律文本与其译文的标注基于语篇信息理论与法律语篇树状信息模式。通过结合霍斯的模型与法律语篇树状信息模式,本文将语场,语旨与语式中的因素转化为法律语篇树状信息模式中的参数。本文将对比不同类型的法律文本与译文,寻找原文与译文间因中西法律文化差异而产生的不同的信息流动方式,并比较不同法律译本在翻译这些法律文化差异时采取的不同策略。最后结合霍斯的模型与法律背景,分析对这些法律文化差异处理的优劣。该研究能够唤起译者在翻译法律文本时对法律文化差异的注意,能够发现对法律翻译造成影响的中西法律文化差异,还能够找到对这些差异处理的有用策略以便今后借鉴。
